TERMS OF SERVICE Updated 08/06/21
All website, logo, graphic design, editing, hosting, print media, or desktop publishing services provided by Hub City Design, hubcitydesign.com, and its partners/subsidiaries, including but not limited to NATE AUSTIN DESIGN, CM DIGITAL MEDIA, residentgeek creative & design, Christian Creative Media, or any contract hires are subject to the following terms and conditions.
Acceptance
Please note that by submitting your down payment for services or payment towards subscriptions you are agreeing to all of our terms of service as written here. Hub City Design reserves the right to change or update these terms at any time without notice.
Charges & Fees
HUB CITY DESIGN requires a minimum 50% down payment on design services before any work will be started. Other percentages may be allowed based on the design company’s decisions. The remaining 50% or other amount is due upon completion of services, or early termination of project by client and before you receive your products, or the website goes live. If final payment is not received within 15 days of the completion of service, additional fees may be added and other action may be taken. Consulting, logos, headers, editing, maintenance, or other custom graphics fees are due at time of hire. Subscription fees are due on date listed on invoice. Failure to pay may result in termination of subscription and result in payment in full being required. Any payments that are late will be assessed a $25 late fee and may be turned over to collections. Any check that does not clear will be charged an additional $75 fee and client will be reported to the collection services.
Web Site Design Credit
Hub City Design and/or CM digital media (Nate Austin) works hard to create specialized websites for a wide range of clients. In order to continue doing what we love, we need a little help! Having our website link on our clients' sites is a great way to get the word out and attract new clients our way. We take great pride in every site we create, and feel that having our name on the sites we design will also deter others from copying our work and marketing it as their own. Therefore, we reserve the right to place a link to our site on every site that we create. If you would prefer to not have our visible link on your site, other agreeable terms can be discussed.
Liability
Copying images, a text or design layout, except templates from other sites is not condoned by Hub City Design. Under NO circumstances will Hub City Design and its owners, partners or contractors be held liable for
content on a client website. The client will pay any and all legal expenses that are a result of lawsuit against
Hub City Design for graphics, images and/or content which is provided by and used by the client.
Termination of Services
Please submit a request for termination of services to Hub City Design in writing. Your request will be reviewed and our response delivered to you in a timely manner. Hub City Design reserves the right to terminate a contract with a client at any time for any reason. If Hub City Design decides to end the contract and services before design is implemented, a suitable refund arrangement will be made. If client terminates the contract before completion without reasonable agreements, payment is due in full immediately. Refunds will be processed within 30 days of the date of termination of contract.
Refunds
Website design is a combination of two things- the web designer's time, and the finished product. Hub City Design requires a minimum deposit of 50% or more on all design projects before we begin; this ensures that should you, the client, decide to change your mind or move to another country, or disappear midway through the project, that we are still paid for some of the time we have put into creating your website. Therefore, there are NO refunds of deposits. Once a site has been completed and live, there are no refunds, period. Please contact us if you have any questions regarding our refund policy. There are no refunds on hosting if it is secured by Hub City Design. Please contact us with any Questions that you have about hosting and we will be happy to answer them.
Hub City Design reserves the right to update or change these terms of service at any time without prior notice.

Hub City Design is committed to protecting your privacy, which is why we have adopted this Privacy Policy. This Privacy Policy is intended to describe how your personal information is processed and used, and we will make every effort to ensure that our activities keep within the spirit of this Privacy Policy. You can tour through most of our site without giving us any information that personally identifies you, reveals personal information or allows us to contact you, but sometimes we do need information to respond to your requests. This privacy statement explains the data we collect from you and its use. Please read the complete privacy statement.

What Information is Hub City Design gathering about its visitors and how is it being used? Every computer connected to the Internet is provided with a domain name (e.g. google.com) and an IP Address (e.g. 156.162.13.113). When a visitor requests a page from within the hubcitydesign.com website, our Web Servers may identify and log the HTTP request that is made to our Web Server. This information reveals nothing personal about you. In fact, very little information is automatically gathered and logged. This information may include:
* The IP address of the site that may have referred you to hubcitydesign.com
* Your IP address
* Operating system that you may be using (e.g. Windows Vista, 7, 10, et all)
* Version and Make of Browser (e.g. Chrome, Safari, Internet Explorer 7.0)
There is nothing special about the information described, and the practice of collecting this data has been generally standardized by virtually every Web Server on the Internet today.
There are two major purposes for this information. Hub City Design has found it advantageous to observe visitor traffic in its aggregate, so that we can ensure maximum compatibility for the various Browsers and Operating Systems that visit our site. Also, generating greater amounts of visitor traffic, as any business should attest, is very desirable. By analyzing visitation patterns, and referring URLs, we can strategically increase our exposure on the Internet.
What about Cookies?
Cookies are files holding small pieces of data that are transferred to your computer's hard drive through your Web browser from our Web Server. A cookie cannot read data from your hard disk or read cookie files that may have been created from other sites. The Hub City Design website may utilize cookies as a means of providing personalization features to our visitors. For example, we may utilize cookies to remember settings (site theme colors, music preferences, what services may interest you, etc.) that you may have made at our website.
You can choose whether to accept cookies by changing the settings of your browser. Typically, by accessing the browser's help feature you can obtain information on how to prevent your browser from accepting all cookies or to notify you when a cookie is being sent. If you choose not to accept cookies, your experience at hubcitydesign.com and other websites may be diminished and some features may not work as intended.
What other information does hubcitydesign.com request?
We may also request your e-mail address, name, company, position, location, web address, services you may be interested in and your comments for the purposes of conducting a survey, or by your request to have someone contact you for additional information. We maintain a strict "No Spam" policy that means we do not intend to sell, rent, or otherwise give your e-mail address to a third-party, without your consent.
In addition, Hub City Design will not send you e-mail that you have not agreed to receive. If you wish to have specific communications with a member of the Hub City Design staff, you will be required to provide specific information that will be routed to the appropriate contact within Hub City Design.
Will Hub City Design disclose the information collected to Third Parties?
Hub City Design will disclose your personal information or any of its logs file information when required by law or in the good-faith belief that such actions are necessary to 1.) Conform to the edicts of the law or comply with a legal process served on Hub City Design 2.) Protect and defend the rights or property of Hub City Design, or visitors of hubcitydesign.com. 3.) Identify persons who may be violating the law, the legal notice, or the rights of third parties. 4.) Cooperate with the investigations of purported unlawful activities.
Hub City Design may disclose information to its partners to better expedite the service(s) you may request from Hub City Design Hub City Design uses reasonable precautions to keep the information disclosed to us secure. We are not responsible for any breach of security or for any actions of any third parties that receive the information. Hub City Design also provides "links" to a wide variety of other web sites on the Internet. We are not responsible for their Privacy Policies or how those web sites manage information about their users. We strongly recommend you to check with those web sites to determine their privacy policy. This privacy statement applies solely to information collected on hubcitydesign.com.
Children's Data
While no part of the hubcitydesign.com website is targeted towards children, we are committed to comply with any applicable laws and/or requirements, such as the United States' Children's Online Privacy Protection Act. No information from anyone, including children is transferred to third parties. While no child should be making a submission to hubcitydesign.com, if any are discovered the information will be deleted immediately.
Any changes to this Privacy Policy will be posted on this page so that you are always aware of the information that we collect, how we use it, and under what circumstances we disclose it. This is not a contract.
